STATE TAXES · RESIDENCY · THE MILITARY SPOUSES RESIDENCY RELIEF ACT

Which state can tax you when you are stationed somewhere else

Orders move you. They do not move your state for tax purposes, and since 2023 a military couple can pick the state that works. Here is the rule for your pay, your spouse's paycheck, and your car, plus the forms.

3state choices a military couple can elect for income tax, any tax year (50 U.S.C. 4001)
The short answer: being somewhere on military orders does not make you a resident of that state for tax purposes, and the same is true for a spouse who is there to be with you. Your military pay is taxed only by your state of legal residence. Your spouse's wages are not taxed by the duty-station state if the spouse's residence is elsewhere. And for any tax year, the two of you may elect to use the member's state, the spouse's state, or the duty-station state. Income that comes from the duty state itself, like a rental or a business there, is still taxed there.

The picker: three states in, four answers out

WHERE YOU STAND

Source: 50 U.S.C. 4001, Residence for tax purposes (as amended through January 5, 2023), and Military OneSource, The Military Spouses Residency Relief Act (October 23, 2025). Checked October 25, 2026. This page explains the federal rule; each state has its own forms and its own tax, and some states tax no wages at all.

The four rules, in plain words

WhatThe ruleWhere it comes from
Your residenceYou neither lose nor gain a state of residence for tax purposes by being somewhere on orders. Neither does your spouse, when they are there to be with you.4001(a)(1), (a)(2)
The electionFor any tax year of the marriage, regardless of when you married, you may elect the member's state, the spouse's state, or the member's permanent duty station.4001(a)(3)
Military payNot income from the state you are serving in, if you are not a resident there. The duty state also may not use your military pay to push up the tax on other income you or your spouse owe it.4001(b), (e)
Spouse's wagesNot income from the state where they are earned, if the spouse is there only to be with you and is not a resident there.4001(c)
Your car and belongingsPersonal property, motor vehicles included, is not treated as located in the duty state for taxes, licenses, fees, or excises, as long as those are paid in your home state. Property used in a trade or business is the exception.4001(d), (g)

What the law does not cover: income that comes from the duty state itself. Military OneSource's own example is rental property. A business run from the duty state is in the same boat. Check with legal assistance before you assume.

The forms, and who they go to

WhoFormWhere
The memberDD Form 2058, State of Legal Residence CertificateYour finance office. It sets which state's tax, if any, is withheld from military pay. DFAS is the form's owner. It records your residence; it does not by itself change where you are domiciled.

Your car, your license, your insurance

Registration. Under 4001(d) and (g), the duty state cannot treat your car as located there for registration fees, licenses, or excise taxes, as long as you pay those in your home state. So keeping the home-state plates while stationed elsewhere is what the law contemplates. Most states publish a nonresident-military page at their motor vehicle agency; that page is the door, and it is also where a spouse's rules show up, since states handle spouses differently.

Driver's license. The statute above is about taxes and fees on the vehicle, not the license in your wallet. Most states let a nonresident service member keep the home-state license while on orders; whether that extends to a spouse is a state rule. Check the duty state's motor vehicle agency before the home-state license expires.

Insurance. Separate from all of this. A policy has to meet the requirements where the car is actually kept, and the insurer decides what it will write. Tell the insurer where the car lives; a mismatch is the thing that voids a claim.

A spouse's professional license moves too

The Veterans Auto and Education Improvement Act of 2022 added license portability to the SCRA. A service member or spouse may use a professional license or certificate in the new state after a move on orders when they: moved because of the orders; give the new state's licensing authority a copy of the orders; actively used the license in the two years before the move; are in good standing with every authority that issued a similar license; and submit to the new authority's standards, discipline, and continuing education rules.

The cases that come up

We are both from a no-tax state and I am working in a state with income tax. Your wages are not income from the duty state under 4001(c). File the duty state's spouse exemption form with your employer. If tax was already withheld, file a nonresident return there to get it back.

My spouse left active duty last week. The protection in 4001(a)(2) is for a spouse who is in the state to be with a member on orders. Once the former member is a civilian, the couple's residency goes back to the ordinary rules: where you live and intend to stay. If you both stay where the member is still stationed, the still-serving member keeps the protection and the spouse rule above applies to the one who got out.

My short-term disability pay was taxed by the duty state. Disability pay that replaces wages generally follows the wage rule, but the payer is a third-party insurer that may not know you are a nonresident. Send the insurer the same exemption paperwork you gave your employer and file the nonresident return for the refund.

Finance will not take the form I brought. The member's withholding is set by DD 2058; a state's own exemption form is for the employer side. Bring the DD 2058 and the orders to finance. If the answer is still no, the installation legal assistance office can write the memo that gets it done.

Can I change my state of legal residence to a no-tax state? Residence is about intent and ties (where you vote, hold a license, register the car, own a home), not a form. A DD 2058 that does not match the facts is the kind of thing that gets unwound years later with back taxes. Legal assistance will walk you through what a real change takes.
